Randy Barnett strongly defends the constitution; however, several authors such as Howell and Moe and Sanford Levinson are of a completely different opinion. William G Howell and Terry M. Moe attack the constitution not because of a mere factual understanding but due to more fundamental disputes about the values. The authors insist that most of the political problems are not as a result of the polarized political class but due to the outdated constitution. The author criticizes the constitution as he feels it is the one responsible for jamming of most of the government’s activities. Additionally, they view the constitution as something protecting only the particularistic interests and propagates dysfunction.
Sanford Levinson, on the other hand, believes that the American constitution is flawed. He argues that most of the political issues we are struggling with have their roots in the faulty constitution. Sanford raises a lot of questions regarding the constitution, which all point towards criticizing it. In his view, the constitution contains some elements of scepticism towards the claims of democratic power. According to him, the constitution has some undemocratic elements that need dramatic change to address the issue. The main reason why Sanford is against the American constitution is that it is undemocratic.
