In this case, the Prasad colleagues violated Federal law, which protects the immigrant’s employment rights. Under the federal anti-discrimination laws, the immigrants should not behave equal employment opportunities and should not be discriminated based on sex, colour, religion, race, age, physical or mental disorder. Therefore, the federal law was violated whereby by Prasad was discriminated by his colleagues based on accent. For example, where Ben would send emails to his team members with jokes and funny images about the Indian culture and also where they laughed made jokes of his natural gestures when he was addressing them.
The employer and the employees are at risk of penalties which may involve monetary fine from the court and prison sentence because of discriminating against Prasad at his place of work due to the accent and nation origin. The employees may also have their work contract terminated due to unethical behaviour.
Prasad, team members and the management have a responsibility to promote the well-being and safety of the children, by ensuring a safe environment at school and even at home. The children are encouraged to speak up their challenges, build their confidence and implement the policies to protect children from abuse and neglect through partnering with parents and the community.
If this occurred at my workplace, being the manager, I would take disciplinary measures such as terminating the contract of the employees. I would also come up with policies that protect employees from any discrimination. Start training programs for employees about creating awareness and the importance of adhering to federal law and also conduct regular employee satisfaction to help identify any challenges they would be facing and take corrective measures.
