RE: Terms of Contracts with Clients
Contract Terms and Conditions
- Duration of the contract – The duration of the contract states the period that the client wants Clean-N-Shine to offer its services. When signing the contract with the client, the date the client wants Clean-N-Shine to begin its services and the date the clients wants it to stop offering services to the client. This is important in the contract so that everyone knows when Clean-N-Shine will be offering its services to a particular client and when to stop offering services. This helps the company to plan itself well. It also helps clients plan themselves in terms of payments and other factors.
- Specify the scope of work – The scope of work describes the specific kinds of services that each client needs. Clean-N-Shine offers a variety of cleaning services that do not necessarily go as a package. A client may need all the services that Clean-N-Shine offer at the same time while another client may want all the services but at a certain interval of time, and some may want a section of the services. Therefore, the services offered by the company depends on the request of the client. To avoid confusions, a client needs to specify in the contract, the types of services required for clarity on what services the client expects.
- Payment schedule – Besides agreeing on the pricing of the services offered to the client, it is important to be clear on how payments will be made. The payment schedule should outline how the client will be making payments, whether weekly, monthly, quarterly or when the service provisions are completed. This condition outlines the channels of payment and the circumstances under which payment is refundable. This is important for both Clean-N-Shine and the clients because both will know how payments will be made, at what time and circumstance for refund.
- Breach of contract – Breach of contract is very common a very serious issue in contracts. In some cases, Clean-N-Shine or the client, for some reasons may fail to honour the contract. When one party fails to live up to their end of the bargain, it is called a breach of contract. Breach of contract is a problem because it affects service delivery, operations and payments. Clean-N-Shine and its clients must have an agreement on how to handle a breach because it is important in promoting commitment to the contract until it is concluded.
- Termination of the contract – Naturally, a contract comes to an end when the duration of the contract specified reaches or when the purpose of the contract is accomplished (Saylor Academy, 2012). In some cases, the contract may need to be terminated because various reasons apart from expiry or completion of purpose. This means that the contract is cancelled early before the goal of the project or expiry reaches. When signing contracts with clients, Clean-N-Shine needs to include the conditions for early cancellation of the contract to prevent problems if a need for cancellation arises. Therefore it is important for both Clean-N-Shine and clients because it helps each party to know what to when a need for cancellation of the contract arises.
