Question 1
I agree with Alexander Hamilton’s statement that “Judiciary is the weakest branch of the government. The Judiciary does a vital role in the society were the judiciary powers are manifested in the courts, and according to the United States constitution (Lewis-Beck et al.,2008). The Judiciary has the potential to oversee disputes being dissolved and help to make decisions based on the legal issues. The Judiciary has the power to do an interpretation of the law, reviewing and pronouncing the law constitutionality or any other legislative and executive acts. The legislative arm of the government has the responsibility of making law and order based on social needs and representations.
The executive has the power to enforce plus implement laws that are made by parliament and interpreted by the Judiciary. Plus, they have the duty and mandate to maintain peace, law and order in the community. Therefore, courts exercise their functions when they are called upon to do so, unlike other arms of the government, they execute their responsibilities independently (Parker,2014). They have the unfettered powers to ensure that other arms act within the laws and regulations that are set for them to work between (Fiorina,1981). The executive appoints members of the Judiciary, and the legislative arm approves them. The Judiciary depends on funds that are being allocated from the executive and the legislature for them to be able to operate; thus, it lacks the power to control finances. Therefore, I agree with Alexander Hamilton’s statement.
Question 2
Political backgrounds act as a reference for what happened and the law that helped the cases that happened are put into reference. Politically, events happen, and they are being likened with past events that happened thus like the law is being amended and some sections of the constitution keep repeating incidents and have similarities on how some cases should be handled (Polsby, Wildavsky & Hopkins,2008). The political background has effects on the current events and how they will be solved with reference to the law and the time they were settled.
In the citizen’s united case that was on Hillary movie documentary over the presidential bill. They demanded traditional American values to limitations, freedom of enterprise and national sovereignty. During the settlement of the case, they considered some rulings that were in the past, such as Austin vs Michigan chamber of commerce that upheld restrictions on corporate political spending (Jacobson & Carson,2019). They also focused on the 2003 decision which upheld the 2002 McCain law of banning election communication that got paid by corporations. This references to the background affected the decision of the citizen united case.
